LEGAL BASES DRAW #ONAHOTELS
1. - Company responsible for the promotion.
The commercial company Clubotel La Dorada, SL (hereinafter Clubotel La Dorada or the Promoter), with registered office at calle Calabria, nº 129, Entlo., 08015 Barcelona, and with NIF B-61502035, develops this promotion called contest of photography in order to boost the hotel offer of Ona Hotels in social networks.
2. - Period of participation.
The validity period of this promotional action and therefore, of participation, will only include until 08/26/2023. The Promoter reserves the right to suspend, postpone, cancel or modify the term of duration indicated above provided that there are causes that justify it, giving sufficient public dissemination of it through social networks.
3. Legitimation to participate.
Legitimation. Individuals over the age of 18 residing in any country may participate in this promotion. All those participants who provide false or untrue information or who, in general, do not comply with the provisions of these Bases will be excluded from this promotion. Regardless of its exclusion, the Promoter reserves the right to take any legal action it deems appropriate against the infringers of these bases. Participation in this promotional draw is by itself free of charge and is open to any user who complies with and accepts these Bases.
Exclusions.
Employees and family members up to the second degree of consanguinity/affinity of the entity Clubotel La Dorada, SL, and of any of its associated companies, advertising agencies or promotion agencies that are related to the promotion and of all those companies involved in carrying out this promotion.
4. - Description of the prizes.
This promotion will have 3 prizes that will be awarded to 3 winners.
The first prize will consist of:
Two nights of accommodation for 2 adults or two adults and one child, sharing the same room* or an apartment with capacity for two people on a Room Only basis, at the hotel of the person's choice from the & Apartments chain.
The second prize will consist of:
One night's accommodation for 2 adults or two adults and one child, sharing the same room* or an apartment with capacity for two people on a Room Only basis, at the hotel of the person's choice from the & Apartments chain.
The third prize will consist of:
10% discount on your next reservation, at the hotel of the person's choice from the Ona Hotels & Apartments chain.
The prize does not include plane tickets or any type of transportation, only the stay and discount. The deadline to enjoy the prize will be September 1, 2024 and the following dates are excluded from the promotion: July, August, Christmas, New Year and Easter. The dates will ultimately depend on the availability of the hotel.
The prize will be considered expired automatically and definitively:
- If the winner does not respond to the e-mail or message that will be sent to inform them that they have been the winner of this contest within 20 days after the end of the contest, accepting said prize. - In cases of cancellation. Clubotel La Dorada, SL, reserves the right to declare the prize void in those cases in which there has been a participation level of less than 25 participants at 23:59 on June 19, 2023. For the enjoyment of the prize, the winner, once communicated to you by Clubotel La Dorada, SL, the awarding of the aforementioned prize must choose the dates of the reservation (check-in date and check-out date), subject to accommodation availability. You should also contact the managers of said promotion by sending an e-mail to reservas@onahotels.com. - The Promoter is not responsible for the use that the prize/incentive makes by the winner. -The waiver of the incentive will not give any right to indemnity or compensation. - The incentives are as set forth in these bases. - In no case will the prize be redeemable for its equivalent monetary value, nor may it be subject to any change or alteration, at the request of the winner. - The participant acknowledges that Clubotel La Dorada, SL will not pay a fee, expense or compensation of any kind, other than the agreed prize for the winner of the promotional action. In particular, and by way of identification, but not limitation, all transportation costs, extra and additional services, food and maintenance (in the event that they are not provided for in the hotel stay regime), and fees and surcharges associated with the stays that are the object of the reservation and outside the applicable regime, will be borne by the prize winner, leaving Clubotel La Dorada, SL and each of the Hotels exempt from any obligation in this regard.
5. - Mechanics.
The participation mechanism takes place via the web and follows the steps in the Instagram post and includes the following steps to participate:

For the purposes provided in Organic Law 1/1982, of May 5, on Civil Protection of the Right to Honor, Personal and Family Privacy and Image itself, it is established that the acceptance of the prize by the winner implies the express granting of the authorization provided for in article 2 to Clubotel La Dorada, SL to use your name and surname, as well as your image, in any public or dissemination activity related to this promotion, without you being entitled to remuneration or obtaining a benefit for this something different from the delivery of the prize. The refusal will involve the automatic waiver of the prize.
6. - Personal data.

8. - Limitation of Liability.
Among other aspects, Clubotel La Dorada is not responsible for:
- For the use of the incentive that the winner can make. - For the services that third-party companies must provide on the occasion of this promotion.
- Due to failures or incidents in the telecommunications systems that prevent access or normal operation of the application.
9. - Reserve of rights.
The Promoter reserves the right to terminate those who are misusing the promotion, who carry out fraudulent acts or harm other participants or who establish speculation or business systems. In the event that Clubotel La Dorada or any entity that is professionally linked to this promotion detects any anomaly or suspects that a participant is preventing the normal development of the promotion, illegally altering their records through any technical or computer procedure, or carrying out any fraudulent acts that contravene its transparency, Clubotel La Dorada reserves the right to cancel and even withdraw the incentive automatically and without explanation of any kind to all those participants who have benefited directly or indirectly from this type of fraudulent actions, and may also exercise all civil or criminal actions that may correspond. 10. - Other considerations.
The prize that is the object of this promotion will be subject to the tax regulations in force applicable at all times and its development provisions. Said applicable regulations could subject the aforementioned prize to taxation, depending on the residence of the winner and the value of the prize, in any case the fiscal cost being fully assumed by the prize winner, as well as the tax obligations that derive from it. In accordance with Spanish tax regulations, the prizes awarded for participation in this type of draw are not subject to withholding or payment on account as long as the value of the prize is less than 300 euros. In any case, it will be up to the winner to comply with any tax obligations due to the prize received.
11. - Acceptance of Bases.

13. - Applicable legislation and jurisdiction.
This promotion is governed by current Spanish legislation. For the knowledge of any dispute that may arise regarding the interpretation or application of these rules, both Clubotel La Dorada and the participants in this promotion expressly submit to the jurisdiction and competence of the Courts and Tribunals of Barcelona expressly waiving any other jurisdiction that may correspond, understood without prejudice to the application of the mandatory provisions of the consumer and user regulations.
